Personally, I think the courts will twist themselves around the issue, ruling that it's an infringement on s7, but that it's "demonstrably justified in a free and democratic society" (s1) and constrain the Quebec decision to just Quebec.

Same as Chaoulli vs Quebec; they will rule that access to a waiting list is not access to healthcare.

It'll be a typical SCOC judgement which amounts to a legal rohrscach (sp??) test which is written in a manner that gives both sides something to crow about.

I think it will be found to violate our rights but will be declared allowable because Alberta doesn't have a provincial bill of rights like Quebec does.

Now if an Alberta PC leadership candidate promised to introduce such a bill of right...things would get interesting.
