Province prepares to defend smoking ban

A looming court battle over Manitoba’s anti-smoking law will hinge on whether the province must treat white bar owners the same as their aboriginal counterparts, an issue that could have implications across the country.
The section of the law that exempted aboriginal reserves from the smoking ban was struck down in August by Justice Albert Clearwater of Court of Queen’s Bench, who ruled it violated the Charter of Rights and Freedoms.

The Manitoba government is trying to appeal the decision by arguing, in part, that the Charter guarantee was not designed to provide a level playing field for white males


The province argues that if everyone must be treated equally under the law, employment equity programs and other initiatives designed to help minorities could be struck down.

The government also argues that financial losses suffered by non-native bar owners, who say their customers have flocked to smoker-friendly native casinos, do not qualify as the effects of discrimination.

I'm in awe. That's just about the worst thing I've ever heard. Purposeful discrimination against any group of people is wrong, even if it is the most empowered (white males).

I think we are living in interesting times. This could well lead to the collapse of that very flawed document, the charter. It appears that there are signs of the imminent collapse of the whole idea of teh modern welfare state, as we are seeing in France.

What will activist judges do when they have to acknowledge that the charter, which is supposed to protect the rights of all, actually destroys the rights of some? If the rights and freedoms of all of us are not protected, could it be that no one has their rights and freedoms protected?

Employment equity programs are terrible. Many employers explicitly claim to be "Equal Opportunity Employers". I don't think it's right for my own government to discriminate against me based on the colour of my skin.

There was an employment centre on my block that had poster that read: "do you want to work for the government of canada?"

and one stipulation said that you had to be a member of a visible minority. It made me so mad, that I wrote an email to the program asking why my dark skinned friend could apply and I couldnt, seeing as though we had similar upbringings. I got no response.

Whitey can't even apply to the RCMP anymore, something is suspicious about the charter.

I'm going to be a bit of a pill here...

the thread is great, but please try not to use words that Google likes to blacklist and downgrade sites over. As such, try not to use racial nicknames (even if they're self-deprecating)

Interesting fact: Fark.com's forums filter some words and substitute them with others so that Google doesn't index their site into obscurity...

Continuing your off topic, sorry. I'm in favor of such a substituting system. If it keeps us from being indexed by Google, then it'll only increase the profile of this site and the BT's in general. It won't really be censorship as everyone will know what's being said anyway.

The biggest gender gap known to "equity" analysts is in PhD Electrical Engineering with WOMEN being paid more than half again as much as men ... women earn 1.52 times what men earn. YET, yet all equity programs without exception say that this is acceptable. ALL OF THEM!

This is what an equity program is ... bigotry enforced by law.

The RCMP is so desperate for candidates as a result of baby boomer attrition, they're being forced to accept caucasian males. Picture that!

Only if your a caucasion female, a friend of mine who is a son of a cop was turned down because he was a white male.

The whole thing goes to today's view that anything may be done to innocent white males and almost anything to ALL of the males ... While in the same breath saying that "minorities" must be treated fairly. Well, the minorities are the majority and by a fair margin.

Look, most white males have things pretty good. The problem we have is when something goes seriously wrong, if you are a white male you are BY LAW not human enough to be helped or treated decently. It's like insurance. Think of the law of equity as:

- all females MUST be insured for all perils
- all males of a racial minority heritage must be insured for race related perils
- it is illegal to insure a white male for any peril

As long as things are good, you're better off being a white male as you don't pay the insurance premium. If something goes wrong though ... Now if you're a white male you are in BIG trouble.

That's the clearest analysis of the law it as it is.

This is why the worst off homeless man is the white lone father: He and his kids are by law not human enough to be helped. The situation can be worse than deadly and is supported by ALL LAW!

The same goes for a battered man, regardless of race. He is by law not human enough to be allowed protection for him and his kids.

On and on it goes ... getting worse every year.
